ACCOUNTING-TEACHER.COM POLICY & PROCEDURES BY VIEWING THESE POLICIES AND PROCEDURES, YOU AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS AND CONDITIONS OF USE AND ANY MODIFICATIONS THEREOF AS MAY BE REQUIRED. A. Educational Purpose 1. Accounting-Teacher.com has been established for educational purposes. The term "educational purpose" includes individual/classroom activities and career development. 2. Accounting-Teacher.com also is an approved Affiliate of QuickBooks (Intuit) and all software and supplies purchased from this website shall be governed by Intuit’s policies and procedures.
B. Authorized Use
1. All students must have access to Internet resources of their own accord by all legal means. You will follow the directions given by the supervisor in the classroom. 2. Students may obtain an individual E-mail account, which is only used for classroom purposes. This will be for class projects only under the supervision of a teacher. Messages are transferred and displayed upon login of the course. 3. Accounting-Teacher.com herby grants you non-exclusive, non-transferable permission to access the content information available at Accounting-teacher.com according to the provisions and subject to payment of the applicable course fee and adherence to these terms.
C. Unacceptable Uses
1. Personal Safety a. You should not post personal contact information about yourself or other people. Personal contact information includes your full name, address, telephone, work address, etc. b. You will promptly disclose to your teacher or other student any message you receive that is inappropriate or makes you feel uncomfortable.
2. Illegal Activities
a. You will not attempt to gain unauthorized access to the Accounting-Teacher.com computer system or to any other computer system through the Internet or go beyond your authorized access. This includes attempting to log in through another person's account or access another person's files. These actions are illegal, even if only for the purposes of “browsing.” b. You will not make deliberate attempts to disrupt the computer system or destroy data by spreading computer viruses or by any other means. These actions are illegal.
3. System Security
a. You are responsible for your individual account and should take all reasonable precautions to prevent others from being able to use your account. Under no conditions should you provide your password to another person. b. You will immediately notify a teacher or the system administrator if you have identified a possible security problem. Do not go looking for security problems, because this may be construed as an illegal attempt to gain access.
4. Inappropriate Language
a. Restrictions against inappropriate language apply to public messages, private messages, and material posted on Web pages. b. You will not use obscene, profane, lewd, vulgar, rude, inflammatory, threatening, or disrespectful language. c. You will not post information that could cause damage or a danger of disruption. d. You will not engage in personal attacks, including prejudicial or discriminatory attacks. e. You will not harass another person. Harassment is persistently acting in a manner that distresses or annoys another person. If you are told by a person to stop sending those messages, you must stop. f. You will not knowingly or recklessly post false or defamatory information about a person or organization.
5. Respect for Privacy
a. You will not repost a message that was sent to you privately without permission of the person who sent you the message. b. You will not post private information about another person.
6. Respecting Resource Limits
a. You will use the course only for educational and career development activities. There may be time limits on the use of the system in order to accommodate more people. b. You will not download software without permission from your teacher. If a download is necessary, you will download the file under the supervision of your teacher or other staff member. c. You will not post chain letters or engage in “spamming.” Spamming is sending an annoying or unnecessary message to a large number of people. d. You will check your e-mail frequently, delete unwanted messages promptly, and stay within your e-mail quota. e. You will not subscribe to mail lists or listservs.
D. Your Rights
1. Free Speech
Your right to free speech, as set forth in the student handbook, also applies to your communication on the Internet. The Internet is considered a limited forum, similar to the school newspaper, and therefore the District may restrict your speech for valid educational reasons. The District will not restrict your speech on the basis of a disagreement with the opinions you are expressing.
2. Due Process
a. Accounting-Teacher.com and it staff will cooperate fully with local, state, or federal officials in any investigation related to any illegal activities conducted through Accounting-Teacher.coms educational system. b. In the event there is a claim that you have violated this Policy of Accounting-Teacher.com’s website system, you will be provided with a written notice of the suspected violation and an opportunity to present an explanation before an administrator. c. If the violation also involves a violation of other provisions dismissal from the course may be given with no refund.
E. Limitation of Liability
1. Accounting Teacher.com makes no guarantee that the functions or the services provided by or through the Accounting-Teacher.com education course will be error-free or without defect. Accounting-Teacher.com will not be responsible for any damage you may suffer, including but not limited to, loss of data or interruptions of service. Accounting-Teacher.com is not responsible for the accuracy or quality of the information obtained through or stored on the system. Accounting-Teacher.com will not be responsible for financial obligations arising through the unauthorized use of the system.
F. Acceptance
1. Please read carefully before accessing the Accounting-Teacher.com’s online eLearning Classes. Accessing Accounting-Teacher.coms website and interactive videos via the internet the user agrees to the terms and conditions herein this agreement. 2. The user is solely responsible for providing the equipment related to accessing the website such as computers, Internet access, software, telephone, personal email, etc.
G. Fee
1. The access granted under these terms is effective only upon payment of the course cost, which are strictly non-refundable. The course cost provides you with unlimited access for a limit of 1 year (365 days). 2. Technical support fees are subject to payment of the standard (per incident) price or Premium (1 year). Once payment is received, the user must schedule with the teacher a date and time in which both the user and the teacher (Certified QuickBooks ProAdvisor) will provide the service. Technical Support can be provided by email, telephone, or direct access. Direct access is obtained by using third party software, which is the user’s responsibility to set up on their own computer. Logmein.com (Free), or gotomycomputer.com (this is not free). 3. On-Site training fee are subject to appointment only. 4. Software purchases and supplies purchased from Accounting-Teacher.com as QuickBooks Affiliate will be governed by policies and procedures set forth by Intuit.
H. Limitations and Liabilities
1. USER ACCESSES THIS SITE AT HIS OR HER OWN RISK. THE SITE IS PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND (BEYOND THE WARRANTIES SET FORTH IN SECTION), EXPRESSED OR IMPLIED, AND ANY AND ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THIRD PARTIES‘ RIGHTS ARE SPECIFICALLY DISCLAIMED. ACCOUNTING-TEACHER.COM DOES NOT WARRANT ANY PARTICULAR RESULT FROM USE OF THE SOFTWARE, SITE. ACCOUNTING-TEACHER.COM DOES NOT WARRANT THAT THE INFORMATION ON THE SITE VIDEOS ARE ACCURATE, COMPLETE OR COMPLIES WITH ANY PARTICULAR LAW OR REGULATION. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL ACCOUNTING-TEACHER.COM OR ANY OF ITS AFFILIATES, AGENTS, EMPLOYEES, SHAREHOLDERS, DIRECTORS, OFFICERS, THIRD PARTY CONTENT PROVIDERS OR ASSIGNS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, LOSS OF DATA, LOSS OF PRODUCTIVITY OR CONTRACT, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. ACCOUNTING-TEACHER.COM IS NOT LIABLE FOR CRIMINAL, TORTIOUS, OR NEGLIGENT ACTIONS OR OMISSIONS OF THIRD PARTIES THAT AFFECT THIS SITE.
1. Indemnification
1. User agrees to defend, indemnify and otherwise hold harmless Accounting-Teacher.com and its employees, successors, and assigns from and against any cause of action or claim, including court costs, expenses and attorney fees, related to or arising from User‘s Prohibited Conduct or other improper or illegal use of the Site.
J. Termination of Agreement
1. Accounting-Teacher.com may terminate this Agreement at any time and at its sole and absolute discretion. Additionally, Accounting-Teacher.com may also terminate Access without notice if it believes, in its sole judgment, that you have breached or may breach any term or condition of this Agreement, or engaged in conduct that deems inappropriate, for its convenience, or for any other reason.
K. Privacy Policy
1. Accounting-Teacher.com will not divulge or provide to any other person/s any of its user’s personal information. We do not market out users to no third parties what so ever. Information we keep is only student enrollment, grade, participation, and completion dates. We do not store your credit card of financial information.
L. Miscellaneous
1. These Terms constitute the entire agreement between Accounting-Teacher.com and user regarding the subject matter hereof. Any previous agreement, whether oral or written, between Accounting-Teacher.com and user dealing with the subject matter hereof is superseded. These Terms may only be modified or amended in writing. If any portion of these Terms is determined to be unenforceable for any reason, such portion will be deemed severed and the remaining terms shall continue in full force and effect. Upon user‘s breach or threatened breach of these Terms, Accounting-Teacher.com may pursue any legal or equitable remedy available, including but not limited to, direct, consequential and punitive damages and injunctive relief. Accounting-Teacher.com remedies are cumulative and not exclusive. Failure of Accounting-Teacher.com to exercise any remedy or enforce any portion of this Agreement at any time shall not operate as a waiver of any remedy or of the right to enforce any portion of the Agreement at any time thereafter. User agrees that regardless of any statute or law to the contrary, any claim or action arising out of or regarding this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred. By Accessing Accounting-Teacher.com, user signs and accepts this shortening of the statutes of limitations. Accounting-Teacher.com makes no representation that the content of Accounting-Teacher.com is appropriate or available for use in all locations. Accounting-Teacher.com operates from the United States and makes no representation that Accounting-Teacher.com complies with any foreign or international laws. You agree to comply with all applicable local laws, including any international laws, while accessing Accounting-Teacher.com, you may not assign your rights or delegate your duties under these Terms. The parties agree that no third party is an intended beneficiary of these Terms.
M. Governing Law & Dispute Resolution
1. These Terms and any claim or action related to or arising from these Terms shall be governed by Hawaii law, without regard to any provision that would make the laws of another jurisdiction applicable. All disputes between you and Accounting-Teacher.com shall be finally resolved through binding arbitration in Honolulu, Hawaii. The arbitration shall be conducted by a single arbitrator who is a retired judge. The parties shall conduct discovery as agreed upon or as permitted by the arbitrator. Each party may bring a claim or action for injunctive relief without submitting the claim to final and binding arbitration. Neither party shall have the obligation to post a bond or demonstrate actual harm before bringing a claim or action for injunctive relief. Each party consents to the exclusive jurisdiction and venue of the Honolulu Superior Court, County of Honolulu, for any equitable claim or action related to or arising from these Terms.
